02Questions and answers

Cyprus from A to Z.

These answers give general orientation. Your individual situation is always assessed with the relevant professional advisers.

How do I obtain Non-Dom status in Cyprus?

To obtain Cyprus Non-Dom status, you should not stay in any other country for more than 183 days and should not have a residence in another country. You must also spend at least 60 days in Cyprus and maintain a permanent home there (owned or rented). To be on the safe side, you should have your Non-Dom status certified.

When does forming a company in Cyprus pay off?

That always depends on the individual case and, not least, on your personal view of what is "worthwhile". Even with smaller annual incomes you can save a considerable amount of tax and social contributions; from a profit of EUR 100,000 you should definitely consider it.

What does forming a company cost?

Set-up costs usually start at EUR 1,500. The total we charge depends on the scope of the services you need. Other costs for onboarding compliance, tax number applications, social insurance registration and so on are listed in our price list.

How long does a formation take?

Around one month until everything is completed. The formation itself takes only 6 days once all documents are available and the company name has been approved.

Is the tax rate in Cyprus really only 5 %?

No. The rate a company pays in Cyprus is 12.5 %. Shareholders can, however, receive dividends tax-free, which is a considerable tax advantage. There are further advantages, but they have to be assessed case by case.

Do I pay tax on dividends I transfer to Cyprus?

No. Foreigners resident in Cyprus benefit from the Non-Dom system. As a result, dividends – even from Cyprus companies – are tax-free (no withholding tax either). Cyprus even waives remittance-basis taxation: dividends paid into your Cyprus account and invested in Cyprus remain tax-free. This is different in many jurisdictions, such as Malta, Madeira and the Channel Islands.

Substance in Cyprus – what does it mean in detail?

Creating substance only matters for people who form a company in Cyprus but do not move there. As we do not offer formation or virtual-office services to entrepreneurs whose main residence and centre of life is not in Cyprus, we do not go into this further.

Do you provide a nominee director and shareholder?

No. That would not be consistent with our previous answer.

How long does a move to Cyprus with a company formation take?

At least two months from the decision to full implementation.

Is it enough to rent a flat in Cyprus?

No. You should not establish or maintain a residence or habitual abode outside Cyprus – specifically, no flat ready for use and no regular stays outside Cyprus. The move must be for an indefinite period. What triggers a residence in a country outside Cyprus can vary, so it is important that you can rule this out under the rules of your home country. You should definitely consult a tax adviser in your home country. We can only outline the principles that apply internationally.

I rent a flat in Cyprus and deregister at home – is that enough? How would the tax office prove otherwise?

Whether your home tax office notices or can prove it is irrelevant: it can still be tax evasion if you keep a residence elsewhere and do not declare taxes there. The tax office does not have to prove anything – the burden of proof is on you.

My wife and children don't have to come along, do they?

Spouse and children usually constitute a taxable centre of life. Anyone who wants their only residence to be in Cyprus has to emigrate with their family – and without any intention of returning.

I move to Cyprus, make some money and return after two years – does that work?

If you have lived in Germany, for example, all your life and emigrate for just two years before returning, you can assume that Germany will rightly presume an intention to return and may tax you retroactively. If you also kept active ties to Germany – a registered car, an actively maintained social circle, regular stays – you can assume you were still considered resident in Germany for the entire period.

Do I have to spend at least 183 days in Cyprus to count as resident?

No. You can use Cyprus as a base and act internationally from there. A home that is ready for use and exclusively available to you, the intention to stay in Cyprus indefinitely and regular stays of at least 60 days a year are sufficient to be considered resident in Cyprus.

Who is a Cyprus solution suitable for?

In principle, anyone who is flexible and can imagine living in Cyprus for part of the year. In our view, the concept suits internet entrepreneurs and international entrepreneurs best – people who can and do work from any phone or computer in the world.

If I decide to go ahead, what is your advice?

Don't do things by halves. Settle into your new home and enjoy up to 340 days of sunshine a year among friendly people. Live the new life the way you set out to. Cyprus will delight you.
